1. Of the judgment of the court of first instance, the part against the Plaintiff A, which corresponds to the following order for payment.
Reasons
1. Facts of recognition;
A. On April 30, 2008, Plaintiff A and TBC Broadcasting Co., Ltd. (hereinafter “TBC Broadcasting”) are companies established for the purpose of operating composite cable broadcasting stations. Plaintiff A entered into a contract on the business of providing digital broadcasts operated by TBC Broadcasting, EBC broadcasting, early high-speed Internet, telephone services, ① customer T&M services for opening and obstructing telecommunications, ② maintenance and repair of subscriber facilities, ③ installation and installation of subscriber line tracks (new, relocation, re-connection, additional, product conversion, etc.), ④ collection of line terminals and equipment, ⑤ education of engineers and materials, ⑤ management of equipment and materials, 7 collection and estimate, and the establishment of TBC Broadcasting to receive fees from EBC Broadcasting (hereinafter “the installation of the instant broadcast service agreement”) and continued to carry out the said business within the scope of each of the instant broadcast service agreements (the term of contract, 2008 to 208-128.13.208).
Article 9 (Claims and Payment of Price) (1) The calculation of service cost shall be based on the settlement data of Ebropid Broadcasting, and shall be notified to Plaintiff A by the seventh day of the following month.
(3) Where a person has an objection to the service charges determined in the following month, he/she shall file a written objection within ten days from the date of request, and where the other party raises an objection, he/she shall determine whether to mediate within ten days from the date of receipt and notify the other party in writing.
Article 13 (Cancellation and Termination of Agreement) (1) In any of the following cases, this Agreement may be rescinded or terminated:
