A defendant shall be punished by imprisonment with prison labor for twelve years.

Punishment of the crime

On December 2003, the Defendant: (a) purchased an instrument for committing a crime, such as D and E, gambling tape, office tape, box tape, gark, and make, which had experienced economic difficulties, such as failure to repay the debt owed to D and their relatives; (b) purchased an instrument for committing a crime from D and E; and (c) conspired F representative Victim G (V, 43 years of age) of the Defendant to commit robbery.

피해자가 “너 누구야”라고 소리를 질렀고 E은 “씹할 년 가만히 있어, 소리치면 죽여”라고 하면서 피해자를 뒷좌석 쪽으로 잡아당겨 이에 피해자가 E이 들고 있던 과도를 잡고 반항하며 뒷좌석으로 넘어가지 않으려고 버티자 D는 피해자의 다리를 들어 뒷좌석 쪽으로 넘기고, E은 왼손 주먹으로 피해자의 얼굴을 2～3회 때려 과도를 놓게 한 다음 과도를 쥔 채 오른손 주먹으로 피해자의 머리와 얼굴, 목 등을 수회 마구 때리면서 피해자의 오른쪽 눈썹과 목, 왼쪽 손목 및 손가락 등이 과도에 찔리거나 베이게 하고 계속하여 피해자를 뒷좌석 쪽으로 잡아당기다가 과도에 피해자의 오른쪽 허벅지가 찔리게 하며 피해자를 뒷좌석 바닥에 얼굴이 향하도록 눕혀 두 발로 피해자의 등을 밟아 눌러 항거불능케 하였다.
