Punishment of the crime

around 15:00 on August 6, 2015, the Defendant changed the certificate of seal imprint and the business registration certificate to the victim in the E-corporate office operated by the victim D ( South, 35 years of age) located in Guro-gu Seoul Metropolitan Government, and changed the victim’s “F 39 million won to sell the F 39 million won to the victim’s property,” and made a false statement to the effect that money would be transferred to the office.

However, in fact, the defendant only thought that he sold the vehicle of the victim and used it for his personal purpose, and did not have any intention or ability to pay it to the victim.

As such, the Defendant, by deceiving the victim, received the above vehicle from the victim, namely, the victim.

On April 27, 2015, the Defendant sent the vehicle to the victim after receiving a request for the purchase of the vehicle from the victim G for the purchase of the vehicle, but on May 5, 2015, the Defendant sent the vehicle to the victim for the purchase of the vehicle. However, on May 5, 2015, the victim was paying the vehicle back on the ground that the said vehicle was not in mind.

On May 6, 2015, the Defendant embezzled KRW 17,650,000 from the return price of the above vehicle deposited in the account under the name of the Defendant for the victim, using it for personal use around that time.

The defendant of "2016 Highest 3232" shall, upon receipt of a muster notice from a person subject to a call-up for education of social service personnel, respond to the call within three days from the date of the call-up notice.

Nevertheless, the Defendant, at around 12:00 on June 25, 2015, did not comply with the call without justifiable grounds until August 30, 2015, when three days have elapsed from August 27, 2015, the date of filing the suit to respond to the call of the Army Training Center at around 14:00 on August 27, 2015.
