1. Basic facts

A. The Plaintiff’s father network D is a person who completed registration of preservation of ownership on the net E on August 24, 1968 on March 9, 1937, as C forest land of 20727 square meters.

From F’s agent F, “10 square meters at the beginning of 100 square meters in the Eastern of G Forest, G, and 1 Dong 2 square meters,” and the forest of this case, including the land in the dispute of this case, was divided into G forest land on October 7, 1970.

On the ground, while residing in the above grassland constructed on the ground, occupied and used the land in the above grassland site and garden, etc., the land in this case died on April 6, 190.

B. The Plaintiff’s mother and H succeeded to the possession of the network D, and instead constructed 74.7 square meters of prefabricated-type housing (a part of 1249 square meters in Macheon-si and a part of the land in the dispute of this case as a site) and died on February 6, 2015, while occupying and using the land in the instant dispute as the site and garden of the instant house, like the network D.

On June 1, 2015, the Plaintiff made an agreement on the division of inherited property between J, K, L, and M, a co-inheritors of the network H, including himself, with the purport that “The heir’s right to claim the transfer of ownership and the transfer of ownership shall belong to the Defendant, with respect to the 330 square meters (10 square meters) from the shore at the end of the end of the mountain season in the instant land among the instant land.”

On the other hand, as of March 7, 1987, N (10,810 shares 10,727; hereinafter “instant shares 1”) and O (9,917, hereinafter “instant shares 2”) shared land as of March 7, 1987

The plaintiff shall register the transfer of ownership on April 15, 2002 with respect to the whole shares of the Nos. 1 and 2 of this case on the grounds of sale as of April 12, 2002.
