A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
1. On October 16, 2007, the defendant was issued a summary order of KRW 1 million on October 26, 2009 with the record of being sentenced to suspension of execution for one year and six months on June 20, 208 by a senior branch office of the Changwon District Public Prosecutor's Office, which was sentenced to suspension of execution for one year and six months on June 20, 2008 by committing a crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny) at the Changwon District Public Prosecutor's Office. On July 24, 2009, the defendant was sentenced to suspension of execution for one year and six years on July 30, 201 by a senior branch office of the Daegu District Public Prosecutor's Office.
A. The Defendant opened a door of a vehicle parked on the street by using the crepans without passing through people in late night hours and thought that the Defendant steals property inside the vehicle to steals.
On February 26, 2017, at around 22:35, the Defendant opened a door-to-be vehicle in front of the Chungcheongnam-dong, Chungcheongnam-do, the Defendant: (a) opened a door-to-door vehicle in front of the Chungcheongnam-do; and (b) opened a door-to-door vehicle in front of the Chungcheongnam-dong, the victim, who was in custody; (c) opened a door-to-face, 4 head of the Saemaul Bank; (d) one head of the post office; and (e) one seal of KRW 5,000 in the market price; and (e) taken off and stolen a seal of KRW 5,500 from the victims on a total of 38 occasions from February 19, 2017 to February 27, 2017; and (e) did not intend to steal, or attempted to steal, property of the victims in total amount of KRW 5,544,500 from the victims, respectively, by means of the foregoing method as indicated in the list of crimes.
B. The Defendant, from around 03:00 on February 27, 2017 to around 04:00 on the same day, opened and intrudes into a H restaurant operated by the Victim G G in the Gyeong-gun, Gyeongnam-gun, Gyeongnam-gun, and thereafter, owned by the victim who was kept in custody at the bottom of the kitchen.
