피고인은 2018. 7. 6. 01:46경 가평군 B에 있는 "C" 유흥주점에서 피고인이 술값을 지불치 않고 소란을 피운다는 112 신고를 접하고 출동한 가평경찰서 D파출소 소속 경찰관 경위 E이 신고 경위에 대하여 청취한 후 피고인에게 "술값을 계산하고 귀가하라"고 하는 것에 화가 나 "짭새들이 왜 술값에 관여하냐"라고 말하며 오른손에 들고 있던 휴대폰으로 위 경찰관의 안면을 1회 가격하는 등 폭행하고, 이후 현행범인으로 체포된 후 밖으로 나와 순찰차로 향하는 과정에서 같은 파출소 소속 경찰관인 경장 F에게 “너는 뭐야, 놓으라고 씹새끼야” 라고 욕설하며 오른 주먹으로 위 경찰관의 왼쪽 안면 부위를 1회 가격하는 등 폭행하여 경찰관의 112 신고 처리에 관한 정당한 공무집행을 방해하였다.
