A defendant shall be punished by imprisonment for a term of one year and ten months.
Reasons
Punishment of the crime
Around February 13, 2015, the Defendant stated that “A” office located in Gangnam-gu Seoul Metropolitan Government Seoul, would sell 130 million won benz S350,000 won when paying down payment to B” by telephone to the victim E.”
However, even if the defendant receives down payment from the injured party, he did not have the intention or ability to sell the benz vehicle to the injured party.
The Defendant received 3,9810,000 won from the injured party as the down payment on the same day in a new bank account (F) under the name of the suspect, as well as from that time to April 21, 2015, the Defendant received a total of 56,109,693 won from the injured party on three occasions in total, as described in the attached crime list, from April 21, 2015.
Accordingly, the defendant was given property by deceiving the victim.
From June 201 to May 2015, the Defendant: (a) from around 2011 to around 1050, the victim, a company selling imported vehicles in Gangnam-gu Seoul Metropolitan Government, the head of the sales division, was a person engaged in vehicle sales business, such as selling a vehicle imported by the victim company to the customer and receiving vehicle payments from the customer; (b) after selling the vehicle to the customer, he/she used the vehicle sales price paid by the customers for personal purposes, such as personal debt repayment, and then used the vehicle sales price paid by the customers for four to five months until the delivery date of the vehicle, and then transferred the vehicle to the victim company by paying the vehicle sales price received from the other customers to the victim company.
1. The Defendant in occupational breach of trust, as seen above, has occupational duties to sell vehicles at the price determined by the company when he/she works as the head of the business division in the victim company and concludes a motor vehicle sales contract with a customer.
