A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On September 28, 2018, the Defendant stated that “The purchase of KRW 480,00 is possible” to the victim E who contacted the victim by reporting that “the Defendant sells Aphone 8 Plphones” posted on the Internet C Kafbook “D”.

However, in fact, the defendant only said that he would sell the mobile phone as above because he needs money under the name of living expenses, and even if he received money from the victim, he did not actually have the intention or ability to sell the mobile phone to the victim

Nevertheless, the Defendant, as above, by deceiving the victim and receiving 480,000 won from the victim through F on the same day, and acquired 2,105,000 won in total from around that time to February 18, 2019, such as the list of crimes (1) as shown in the attached Table of Crimes (1).

Around August 5, 2017, the Defendant posted a false statement on “sale of computer monitors” on the Internet CKafin’s bulletin board of “D,” and made a false statement on “2.10,000 won to the victim G who visited the Defendant.”

However, as the defendant did not possess any goods, there was no intention or ability to send such goods even if he receives the price from the victim.

As above, the Defendant, by deceiving the victim, received KRW 2.10,00 from the Hbank account (I) in the name of the Defendant on the same day, and received a total of KRW 3.53 million from that time to December 27 of the same year, as shown in the attached Table of Crimes (2).

The Defendant, on February 14, 2019, posted the Defendant’s notice to the effect that he would sell pressure circulation devices on the Internet Kabane on February 14, 2019, was in contact with the victimJ, and the said machinery was 110,000 won.
