Summary of Grounds for Appeal

The sentencing of the court below (one year of imprisonment, one year of suspended execution, and 80 hours of community service) is too unfluent and unfair.

Considering the fact that the amount of damage caused by the instant crime exceeds KRW 14 million, the fact that there is no record of the crime punishable or exceeding the fine for the same kind of crime, the fact that the Defendant’s age, character and conduct, motive, means and consequence of the crime, and all other circumstances indicated in the instant case, such as the circumstances after the crime, etc., the lower court’s sentencing is too unjustifiable and unreasonable.

Therefore, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act. It is so decided as per Disposition.
