A defendant shall be punished by imprisonment for six months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

In light of the need to pay a premium, the Defendant, taking advantage of the fact that an insurance solicitor receives a sales allowance from an insurance company, purchased an insurance policy with a personal-friendly insurance solicitor, paid a normal insurance premium, and maintained the insurance. The Defendant attempted to pay the sales allowance from the insurance policy to the insurance solicitor who requires the sales performance in a normal manner and pay the insurance premium to him/her, and then receive the sales allowance from the insurance solicitor with the intention to maintain the insurance policy. In the end, the Defendant attempted to receive the sales allowance first through the insurance solicitor without the intention to pay the insurance premium in a normal manner.

1. On July 19, 2010, around 14:00 on July 19, 2010, the criminal defendant against the victim C Co., Ltd. stated that “F, an insurance solicitor of the victim Co., Ltd., who is an insurance solicitor of the victim Co., Ltd., would purchase sales allowances from the purchase of insurance, and maintain the insurance while paying a normal insurance premium.”

However, the defendant did not have the intention or ability to pay the premium normally.

The Defendant, as such, deceivings the victim through F to buy G insurance around July 29, 2010, and then is subject to the same year from the victim.

8. Around 20.20. Around January 20. F, a sales allowance of KRW 1,180,000 for the purchase of the said insurance through F was received and acquired through deception, and from that time, a total of KRW 23,857,50,000 was paid through the same method from January 20, 201, as shown in the attached Table 1 of the Crimes List.

2. On December 19, 201, the Defendant, at the victim H Co., Ltd. E office around 13:00, purchased sales allowances due to the purchase of insurance from the victim Co., Ltd. to I, an insurance solicitor of the victim Co., Ltd., and paid the insurance premium normally.
