Reasons
Punishment of the crime
1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury to Dangerous Driving) is a person engaging in driving a B rocketing car.
On July 22, 2020, the Defendant driven the said car under the influence of alcohol level of 0.240% on blood alcohol level around 01:00, and led the Defendant to drive the said car in accordance with three-lanes between the 00-lane and the two-lane distance from the 00-lane side of the military mountain city.
In this case, a driver of a motor vehicle has a duty of care to check the safety of course and accurately manipulate the steering direction and brake system to prevent accidents in advance.
Nevertheless, under the influence of alcohol, the Defendant got into the left-hand part of the Defendant’s passenger vehicle operated by the victim D (Nam, 48 years old) who is driving in the two-lane due to the negligence of neglecting it as they were, and continued to proceed in the Defendant’s front-hand part of the G rocketing taxi driven by the Victim F (Nam, 67 years old) who is driving in the Defendant’s front-hand part.
Ultimately, the Defendant driven the said car in a state where normal driving is difficult due to influence of drinking, and suffered injury to the victim D, such as salt, tensions, etc., which requires approximately two weeks of medical treatment, and injury to the victim F, such as brain-dead, etc., which requires approximately two weeks of medical treatment.
2. The Defendant, at the time and place specified in Paragraph 1, driven B rocketing car under the influence of alcohol by 0.240% in blood alcohol concentration.
