Criminal facts
The Defendant is a person operating C B BBK, and the victim D is a person operating the E boiler stoves representative, and was in competition with each other in the supply business of F apartment heating boiler in the regular Eup/Myeon.
The defendant, around 19:00 on October 18, 2013, when the above apartment house was converted from the central heating to the individual heating, the result of the residents' voting for joint purchase of boiler was selected as a final candidate for the defendant and the victim's company, and the defendant selected the victim's company as a joint purchaser company on October 21, 2013.
At around 17:30 on October 24, 2013, the Defendant distributed to the majority of the unspecified residents the printed materials, stating the following false facts: “The fact that the “G” model bided by the victim was the product of 2013-type, and the “H” and the “H” model, which was the originally scheduled bid model, is not significantly different in terms of the price and quality; and that the model is to be replaced at the 8th day of the same month. However, despite the apartment management office’s delivery to the residents through the apartment management office, the Defendant presented the lowest type boiler first at the first time and advertised it on the bulletin board, but the final boiler was trying to supply it to the old boiler with the high quality of alkinum material, which was significantly low in quality.”
Accordingly, the defendant knew false facts and interfered with the victim's boiler sales business.
