A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant is between the actors under B and law, and the Defendant, as to C Apartment-gu Seoul Metropolitan Government apartment 101 Dong 1201, which was owned by B, set up a collateral on the leased enterprise with the Defendant as the debtor, and thought to receive a loan.
1. Forging a private document or uttering of a falsified investigation document;
A. On March 24, 2015, the Defendant: (a) on March 24, 2015, stated “B” in the letter of delegation for certification of seal imprint although he/she was not authorized to obtain the certificate of seal imprint from B at the 1 Dong Office in Yeongdeungpo-gu Seoul, Yeongdeungpo-gu, Seoul; (b) stated “B” in the letter of delegation for certification of seal imprint; (c) stated “D” in the resident registration number column and “E apartment 101-1201” in the state column; (d) forged a letter of delegation in B’s name; and (e) submitted a forged letter of delegation to the staff in charge of the said office, who was aware of the fact, as if he/she was duly formed.
Accordingly, the defendant has forged and exercised a letter of delegation in B's name for the purpose of exercising without authority.
B. On March 25, 2015, the Defendant committed a crime on March 25, 2015, the Defendant stated “Seoul Yeongdeungpo-gu Seoul Metropolitan Government, Yeongdeungpo-gu, 101 Dong-gu, 101 Dong-1201” on the number of the building on which the name cannot be known at the G Certified Judicial Scriveners Office located in Yeongdeungpo-gu Seoul Metropolitan Government Office, and stated “B, Yeongdeungpo-gu Seoul Metropolitan Government, c, 101 Dong-1201 Dong-1201, and affixed the name of representative director on the title of the building on which the indication of real estate was made; on March 25, 2015, the “right to collateral security contract” was created in the column for the purpose of registration; on March 25, 2015, the amount of KRW 300,000,000 (30,000,000,000) as “A,1201 Dong-gu, Seoul Metropolitan Government, and the name of the representative is forged.
