A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
1. The Defendant committed fraud, around September 3, 2009, told the victim D to supply the PVC windows corresponding to the construction cost of the household unit of the model hybrid, and supply the PVC windows necessary for the construction cost of the 19 household unit continuously.
However, in fact, the Defendant had been in a situation where the Defendant had been operating in the past due to a debt worth of KRW 4 billion and settled the interest thereon, and the construction cost, which was partially received from the owner, should be paid as field personnel expenses, etc., and there was no other financial ability to perform the construction work, and even if goods are supplied from D, there was no intention or ability to pay the price.
The Defendant, as such, by deceiving D and being supplied with the PVC head equivalent to KRW 2,365,328 on the same day from the victim D, and acquired it through the supply of the PVC head on six occasions, such as the entry in the attached list of crimes.
2. On February 9, 2010, the Defendant: (a) around February 9, 2010, drafted a notarial deed stating that a notary public in the Dong-gu Gwangju-gu shall pay his/her debts from law firm F, and from the same creditors as described in paragraph (1), D, the same as described in paragraph (1), shall accept compulsory execution upon the expiration of the due date; (b) however, he/she had the intent to evade compulsory execution from D as it is difficult to repay the said debts by the due date.
