A defendant shall be punished by imprisonment for one year.

However, the execution of the above sentence shall be suspended for three years from the date this judgment became final and conclusive.

Punishment of the crime

The Defendant practically operates the “D Regional Child Center” in Gwangju Northern-gu, the “F Regional Child Center” in the Southern-gun E, and manages the “H Regional Child Center” and the “J Local Child Center” in Gwangju Northern-gu G, Gwangju Northern-gu I, and has been engaged in the execution and settlement of subsidies granted to the said Child Center from the North-gu Office in the Gwangju Metropolitan City, North-gu, and the Namsung-gun.

The above subsidies shall not be used for any other purpose by performing the duty of due care as a good manager for a person who executes and settle the subsidies from a local child center financed with 50% of the national expenses, 20% of the Si expenses, and 25% of the expenses.

Nevertheless, the Defendant applied for a monthly subsidy from January 31, 2012 to December 28, 2015 and deposited it in the account under the name of the above regional child centers, and deposited it for the victim D regional child centers, F regional child centers, H regional child centers, and J regional child centers. On January 31, 2013, the Defendant distributed KRW 1,30,000 to the bank account under the name of the Defendant’s management and used it for the personal purpose, such as repayment of debt, etc., and then withdrawn it for the personal purpose by voluntarily using the personal account of the Defendant’s bank managing KRW 86,701,41 in total through 224 times as shown in the attached Table of Crimes.
