Defendant shall be punished by a fine of KRW 2,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. On October 20, 2012, the Defendant stated that “The Defendant would purchase and sell 100,000 won of the gift certificates to the victim B at a mutually influent restaurant located in the Guri-si, Seori-si, Seori-si, that “The purchase price of the gift certificates would be at least 16% left behind by purchasing and selling them, as it is possible to purchase 10,000 won of the gift certificates.”

However, the defendant did not have any intention or ability to purchase and sell the gift certificates despite receiving the purchase price for the gift certificates.

On October 25, 2012, the Defendant, by deceiving the victim as such, received 4 million won from the victim, under the name of the Defendant, as the purchase price for the gift certificates, and acquired it by deceit.

2. On December 26, 2012, the Defendant posted a letter “I will sell S5 Smartphones for KRW 1.60,000,00” on the Chinese and French Rolar on a non-displace, and said, the Defendant told C who contacted the victim that I will send the price first.”

However, in fact, the defendant did not have the intention or ability to send it even if he receives the payment because he did not have S5 Smartphones.

As such, the Defendant, by deceiving the victim, received 1,60,000 won from the victim to the above Suhyup account as the mobile phone price, and acquired it by fraud.

3. On September 23, 2013, the Defendant posted a letter stating that “the traffic card flag is sold to KRW 80,000,000,” on the NAV car page at an insular place, and said that “the Defendant will send the goods if the price is first sent.”

However, the defendant did not have a traffic card and did not have an intention or ability to send it even if he receives the price.

The Defendant, by deceiving the victim as such, received 84,000 won (including selective transfer expenses 4,000 won) from the victim as the price for traffic card from the victim and acquired it through the victim.
