Defendant
A is a person operating the “J” and “K” of the medical device sales chain in Jeju City I and 501. Defendant B is a person operating L, 201 of the medical device sales business entity in Jeju City L, M, and N. The Defendant D is a person operating the “P” of the medical device sales business entity in Jeju, and Defendant C is a person in charge of the purchase of goods belonging to Q general affairs department.
1. Joint crimes committed by Defendant A and Defendant D
A. The Defendants related to the supply of Q blood automatic analysis devices: (a) in relation to the supply of blood automatic analysis devices in the case of the "2012 National Treasury Support Medical Equipment Purchase (Public Notice Number (S)", which was publicly announced by Q around the R date, the Defendants conspired to supply the devices under the name of J Co., Ltd., Defendant D after collusion with the bid price in advance, and actually being awarded a bid by Defendant A; (b) around the 6th of the same month, Defendant A connected each of the P Co., Ltd.’s offices to the supply of the devices in the name of J Co., Ltd.; and (c) Defendant D was linked from each of the P Co., Ltd.’s office to each of the national sites of the Public Procurement Service (www.2bb.go.r.); and (d) as determined in advance on the supply of the above automatic blood analysis devices, J Co., Ltd., Ltd. and P Co. 73,000,000 won for the 10th of the same month.
B. The Defendants related to the tendering procedure for Qbrus supply are invited to negotiate bid prices with regard to the supply of sediment disinfection equipment (Public Notice Number: S) from among the cases of the above 2012 National Treasury Support Act, to obtain a successful bid. Around September 6, 2013, the Defendants connected each of the places listed in the above paragraph (a) to the site of the country of the Public Procurement Service using a computer at each of the places listed in the above paragraph (a) and then, as determined in advance regarding the supply of sediment disinfection, J Co. 38,60,000, P Co., Ltd. and 39,600,000 won and received a successful bid by the JJ around the 10th day of the same month.
