피고인은 2019. 8. 14.경 고양시 덕양구 B아파트 C호 소재 피고인의 주거지에서, 판매자 D(32세, 텔레그램 닉네임 E)가 인터넷 F 사이트에 게시한 ‘희긔영상 레어전문, 여고딩, #노예녀, #초딩, #중딩, #고딩 등의 영상을 판매한다, 상세한 영상의 내용을 확인하려면 텔레그램 G 채널에 접속하여 구매하면 된다’라는 광고글을 보고 위 텔레그램 채널(G)에 접속하여 샘플 영상과 사진을 확인한 다음 10만 원 상당의 온라인 문화상품권 PIN 번호를 전송해주고 그에 해당하는 별지 범죄일람표 기재 아동ㆍ청소년이용음란물 3,510건이 압축파일 형태로 저장되어 있는 텔레그램의 접속링크를 피고인 소유의 휴대전화로 전송받아 이에 접속하여 아동ㆍ청소년이용음란물을 시청하거나 보관하는 방법으로 아동ㆍ청소년이용음란물을 소지하였다.
