1. All of the plaintiffs' claims are dismissed.

2. The costs of lawsuit are assessed against the plaintiffs.

1. Basic facts

A. The defendant is a housing reconstruction and rearrangement project association established to implement a housing reconstruction project in which J members of the Namyang-si City is a project implementation district (hereinafter "the project in this case"). The plaintiff A is the real estate listed in the attached Table 1, the plaintiff B is the real estate listed in the attached Table 2, the plaintiff C is the real estate listed in the attached Table 3, the plaintiff Eul is the real estate listed in the attached Table 4, the plaintiff E is the real estate listed in the attached Table 5, the plaintiff F is the real estate listed in the attached Table 6, and the

B. Defendant’s establishment details 1) K Promotion Committee (hereinafter “instant promotion committee”)

on April 30, 2003, the Inaugural General Meeting for the Establishment of Housing Reconstruction Association (hereinafter referred to as the “Inaugural General Meeting of this case”).

(2) Around May 23, 2003, the instant promotion committee passed the resolution of the inaugural general meeting of this case, including the “number of partners: 290 square meters; 20,877 square meters; 480 households; 24, 34, 44 square meters; 8 square meters; 24 square meters; 8 square meters and 24 square meters; 8 square meters; 8 square meters; 8 square meters; 24 square meters; 8 square meters; 8 square meters; 24 square meters; etc.; and “association head of the association and the auditor’s election”; and “case of approval for the business plan,” etc.

2) The Plaintiff filed an application for authorization for the establishment of a housing reconstruction project association (hereinafter “application for authorization of this case”) along with the name written consent of the reconstruction project association.

3) The Mayor of Namyang-ju is in force at the time of the application for authorization of the case No. 1, the former Housing Construction Promotion Act (amended by Act No. 6852 of Dec. 30, 2002; hereinafter the same shall apply).

The reconstruction object shall be a part on the ground that it is included in an unre-buildingable detached house.
