1. The plaintiff's claim is dismissed.

Reasons
1. Basic facts
A. The Defendant lent KRW 200 million on April 6, 2007, and the Plaintiff lent KRW 300 million on April 9, 2007 to Nonparty Y Co., Ltd. (hereinafter “S&M”) on the pretext of investment in each business fund.
나. 제이에스디앤엠은 2007. 4. 9. 주식회사 스카이팰레스(이하 ‘스카이팰레스’라 한다)에게 울산 중구 D 대 168.6㎡ 및 그 지상 건물(이하 ‘이 사건 부동산’이라 한다)에 관한 재건축사업 시행 사업권(이하 ‘이 사건 사업시행권’이라 한다)을 8억 원에 양도하였다.
다. 스카이팰레스는 같은 날 원고와 사이에, 원고와 피고를 포함한 투자자들에 대한 각 차용금 채무를 담보하기 위해 대표로 원고 명의로 울산 중구 D 대 168.6㎡ 및 그 지상 건물(이하 ‘이 사건 부동산’이라 한다)에 관하여 채권최고액을 1,600,000,000원으로 하는 근저당권을 설정하여 주기로 하는 근저당권설정계약을 체결하고, 근저당권자를 원고로 하여 울산지방법원 중부등기소 2007. 4. 9. 접수 제25259호로 근저당권설정등기(이하 ‘이 사건 근저당권’이라 한다)를 마쳤다. 라.
On October 9, 2008, the Plaintiff entered into a contract with the Defendant to transfer the right to collateral security equivalent to KRW 400,000,000, out of the maximum debt amount of the instant right to collateral security, which is KRW 1,600,000,000. On October 10, 2008, the Plaintiff completed the supplementary registration of partial transfer of the right to collateral security, which is the additional registration of KRW 400,000,00,000, among the maximum debt amount of the instant right to collateral security, on the ground of partial subrogation of the claim as of October 10, 2008, Ulsan District Court Decision 82071, which was received on October 10, 2008.
E. On December 27, 2013, the Defendant applied for a voluntary auction on the instant real estate (hereinafter “instant voluntary auction”), and the Ulsan District Court rendered a decision to commence the voluntary auction on December 30, 2013.
The Ulsan District Court was the real proceeds from the sale of the real estate of this case on July 30, 2014.
