1. The defendant shall be punished by imprisonment for eight months;

2.Provided, That the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around 07:00 on March 23, 2016, the Defendant driving CM7 car under the influence of alcohol content of approximately 0.061% from the area of approximately 6km to the international apartment parking lot located in the Nam-gu, Busan Metropolitan City on the same day from “the frequency of cattle” located in the document culture of 22-1 (Boo-dong) to the Busan Metropolitan City on the same day, around 08:10 on the same day.

2. The Defendant is a person who is engaged in driving service of the CM7 car in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (i.e., escapeing vehicle) and the Road Traffic Act (ii).

피고인은 2016. 3. 23. 07:50 경 제 1 항의 기재와 같이 술에 취한 상태에서 위 승용차를 운전하여 부산 남구 D에 있는 E 회사 건너편의 편도 2 차로 도로를 동천 삼거리 쪽에서 감만동 쪽으로 2 차로를 따라 시속 약 50km 로 운행하던 중 졸음 운전을 한 과실로 우측으로 미끄러지면서 도로 우측에 설치된 연석을 충격한 후 급격하게 좌측으로 튕겨 나와 피고인이 운전하는 승용차 운전석 부분으로 때마침 1 차로를 직진하던 피해자 F(39 세) 가 운전하는 G 화물차 우측 앞부분을 들이 받았고, 그 충격으로 위 화물차가 중앙선을 넘어 앞 범퍼 부분으로 반대방향 1 차로를 직진하던 피해자 H( 여, 30세) 운전의 I K3 승용차의 앞 범퍼를 들이받게 하였다.
