The prosecutor's appeal is dismissed.

1. The summary of the grounds for appeal is unreasonable because the sentence imposed by the court below on the defendant (two months of imprisonment, two years of suspended sentence, two years of suspended sentence, confiscation, and return) is too unfasible.

2. In full view of the following circumstances: (a) the Defendant was punished for the same kind of crime; (b) the Defendant recognized all of the instant crimes; (c) the amount of damage caused by the instant crime was not significant; and (d) the motive, means, and consequence of the instant crime; and (c) other circumstances that form the conditions of the pleadings and the sentencing specified in the records, such as the circumstances after the instant crime, are deemed adequate.

Therefore, the prosecutor's assertion of unfair sentencing is without merit.

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act as it is without merit. It is so decided as per Disposition.
