The defendant shall be punished by imprisonment with prison labor for not less than six months and by imprisonment for not less than four months for the crimes of Nos. 4 through 7 of the decision.

Punishment of the crime

[criminal history] The Defendant was sentenced to a suspended sentence of 1 year and a fine of 1 million won on June 2, 2018 for a violation of the Aviation Security Act by the Incheon District Court on May 25, 2018, which became final and conclusive on June 2, 2018.

[ criminal facts] No person shall purchase or smoke marijuana, and he/she may purchase, receive, administer, or possess marijuana, the cryptop crypto (one clopon; hereinafter “copon”), which is a local mental medicine-related person.

Despite the fact that the Defendant is not a narcotics handler, the Defendant treated narcotics as follows:

1. On January 1, 2018, the Defendant: (a) at C’s residence near the Gangnam-gu Seoul Metropolitan City B hotel, received approximately KRW 1.5 million as the price for the purchase of penphones and marijuana from C; and (b) approximately 3g of a penphone, which is contained in the plastic bag, and approximately 5g of marijuana, which is contained in the plastic bag, from C.

Accordingly, the Defendant purchased approximately 3g of philophones and approximately 5g of hemps from C in KRW 1.5 million.

2. On January 2018, the Defendant administered philophones by inserting approximately 0.3g of philophones into the Seocho-gu Seoul Metropolitan Government D building, the Defendant’s residence at the lower bottom of the new wall, and in a method of inhaleing smokes generated by heating the bottom of flokes into the plug.

3. On February 2, 2018, the Defendant administered approximately 0.3g of philopon at the residence of the above Defendant, in the same manner as the above 2.3g.

4. On June 2018, the Defendant: (a) took approximately 0.3g of philopon from F at the residence of the above Defendant, she was snicked in the nesp flack and administered it in the same manner as the foregoing 2.

5. On July 18, 2018, the Defendant passed through a marijuana smoking machine made by sticking a iron powder at the place of residence of the said Defendant at the entrance of the said Defendant, wherein the smoke generated by heating the scopic amount of marijuana, pass through water inside the water disease.
