A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for four years from the date this judgment becomes final and conclusive.

Punishment of the crime

A victim B (a person, a woman, and the age of 24) was an employee at the D convenience store located in the window C of Changwon-si, and the victim E (a person, a woman, and the age of 19) was the latter part of the victim B, and it was difficult for the victim B to wait until the victim B completes his/her service.

The defendant is a single customer of the above convenience store, and it is a space between the above victims and the several times at the above convenience store.

1. 2020. 5.경 피해자 B에 대한 강제추행 피고인은 2020. 5. 새벽경 위 편의점에서 피해자 B을 기다리고 있던 E에게 검은콩 우유를 주면서 ‘쟤(피해자를 지칭)는 살이 돼지같이 쪄서 살 빼야 되니까 이런거 마시면 안되고, 니 마셔라’라고 하였고, 이에 피해자가 카운터에서 나와 피고인에게 불쾌하다는 취지로 이야기하자 ‘아, 그게 뭐, 그냥 나이 든 사람의 농담인데’라고 하면서 갑자기 한 손으로 피해자의 엉덩이를 1회 때리고 주물러 피해자를 강제로 추행하였다.

On July 14, 2020, the Defendant committed indecent act against the victim B around July 14, 2020: (a) around 04:40 on July 14, 2020, the Defendant: (b) committed indecent act by indecent act against the victim; (c) committed an indecent act against the victim’s right upper part of the victim’s chest with one hand; and (d) continued to talk with the victim before the convenience store, and (e) took the victim’s upper part with his hand, and (e) took the victim’s upper part with the victim’s hand, and (e) took the victim’s upper part with the victim’s own hand, and (e) led the victim to an indecent act by force by force against the victim’s rear part.
