1. The defendant shall be the plaintiff.
(a) KRW 23,448,429 and interest rate of KRW 20% per annum from March 25, 2015 to the date of complete payment.
Reasons
1. On January 1, 2010, the Plaintiff leased each real estate listed in the separate sheet to the Defendant, with a fixed period of KRW 45 million per month, KRW 4.95 million per month, and KRW 2 years per month.
The above lease contract was renewed on December 31, 201, and renewed on December 31, 2013, and the rent was increased to KRW 5,500,000 per month.
However, on January 31, 2015, the Plaintiff lawfully terminated the above lease contract on the grounds of the Defendant’s delinquency in rent. As such, the Defendant is obligated to pay to the Plaintiff the remainder of KRW 23,448,429 calculated by deducting deposit KRW 45 million from KRW 68,448,429, which is the sum of the rent in arrears and the amount of unjust enrichment equivalent to the rent in arrears until February 28, 2015, and damages for delay as well as the amount of unjust enrichment equivalent to the rent from March 1, 2015.
