1. The defendant shall pay 48,963,00 won to the plaintiff and 12% per annum from September 26, 2019 to the day of complete payment.

During the period of February, the Defendant (on the spot: Kimpo-si Officetel and the site of construction works for the construction of a new site) leased 1 unit of port and port launch and 1 unit of astronomical machine. However, the Defendant paid 35 million won out of the above construction machine rent of KRW 83,963,00 (including value-added tax) and did not pay the remainder between the parties.

According to the above facts, the defendant is obligated to pay to the plaintiff 48,963,00 won payable for the above construction machinery rent (=83,963,000 won - 35,000,000 won) and damages for delay calculated at the rate of 12% per annum under the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings from September 26, 2019 to the date of full payment after the original copy of the instant payment order was served on the defendant as requested by the plaintiff.

Therefore, the plaintiff's claim of this case is justified, and it is so decided as per Disposition.
