1. The defendant's appeal is dismissed.

The defendant's grounds for appeal citing the judgment of the court of first instance are not significantly different from the argument in the court of first instance, and even if each evidence submitted to the court of first instance (Evidence 1 and the result of the defendant's examination) was presented to this court, the fact-finding and judgment of the court of first instance are justified.

Therefore, the reasoning of the judgment of this court is identical to the reasoning of the judgment of the court of first instance.

2. The judgment of the court of first instance is just, and the defendant's appeal is dismissed.

However, the judgment of the court of first instance is modified in accordance with Paragraph (3) of this Article by the reduction of the plaintiff's claim.
