A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2013. 7. 14. 00:30경 수원시 팔달구 C 아파트 103동 1305호에서, 대학교 과 친구인 D의 신혼집 마련 집들이 기념으로 위 D 부부, E, F, G, 피해자 H(여, 22세)과 함께 술을 마시던 중 위 D 부부, F가 잠이 들고, 피해자가 자겠다며 작은 방으로 들어간 후 E, G가 밖으로 나가자 피해자가 있는 방으로 들어가 피해자의 가슴을 만지면서 피해자가 깊게 잠이 든 것을 확인한 다음 피해자의 항거불능 상태를 이용하여 피해자를 간음하기로 마음먹고 피해자의 상의 블라우스를 벗기고 브래지어와 민소매티를 목까지 걷어 올리고, 피해자의 입술에 자신의 혀를 넣으려고 시도하다가 피해자의 가슴을 손으로 주물럭거리며 혀로 핥고, 피해자의 반바지와 팬티를 벗겨 손으로 피해자의 음부를 만지다가 검지와 중지를 피해자의 질 내에 넣었다가 빼는 행위를 반복하면서 자신의 성기를 움켜잡고 자위행위를 하고, 이어 자신의 성기를 피해자의 음부에 대고 수회 비벼대며 질 내로 삽입하려 하였으나 발기가 잘 되지 않아 삽입하지 못하였다.

Accordingly, the defendant attempted to engage in sexual intercourse by taking advantage of the victim's state of impossibility to resist, but did not have such intent but failed to do so.
