Defendant
All appeals filed by A, C and Prosecutor are dismissed.
Reasons
1. Summary of grounds for appeal;
A. Defendants 1) In light of the fact that Defendant A committed the instant crime in contingency under the influence of alcohol, the victim I, L does not want to be punished against the Defendant, the Defendant is the most supported by two children, and the Defendant is in depth divided, the punishment sentenced by the lower court is too unreasonable.
2) In light of the fact that Defendant C’s joint assault crime of this case does not have significant damage, and that the victim does not want the punishment of the victim L at the investigation stage by agreement with the victim L at the investigation stage, and that the defendant is able to live faithfully for his family without committing a second offense in depth, the punishment sentenced by the court below is too unreasonable.
B. In light of the fact that all the Defendants were guilty of multiple violence, and the Defendants committed the instant crime during the period of repeated crime, the sentence imposed by the lower court is too uneasible and unreasonable.
2. Determination
A. We also examine the defendant A and prosecutor's assertion of sentencing, and the prosecutor's argument of sentencing.
Although the defendant has been punished several times for the same crime, each of the crimes of this case was committed during the period of repeated crime of obstruction of fraud and exercise of rights.
On the other hand, the damage caused by each joint assault of this case is not so significant, and the victim I and L do not want to be punished by the defendant.
In addition, considering the various circumstances asserted by the Defendant and the Prosecutor on the grounds of appeal, the lower court’s punishment is too heavy or unfasible, even in light of the circumstances asserted by the Defendant and the Prosecutor, such as the Defendant’s age, sex, environment, motive, means, and consequence of the Defendant’s act, including favorable or unfavorable circumstances.
