1. All of the plaintiffs' primary claims are dismissed.
2. The lawsuit filed against the plaintiff A and C's ancillary claim.
Reasons
1. Basic facts
A. 521 sectional owners of the building E located in the e-site (hereinafter “instant building”) are 521 sectional owners, and the area of the entire section for exclusive use is 49,908 square meters.
Agenda: The head of the management body and the person to whom the appointment of managing members is delegated: F (Divided owners), the content of the acceptance: D Officetel and commercial buildings shall consent to the establishment of management body, and the attendance and voting rights of the general meeting for the establishment of management body shall be delegated to the above person.
Period of delegation: Until the establishment and management of the management body of Dtel and commercial buildings and the appointment of management members is completed;
B. F and G, who are the sectional owners of the instant building, were issued, respectively, the power of attorney with the following contents from other sectional owners (hereinafter “instant power of attorney”).
C. F constituted the “Dtel/Ban Emergency Countermeasure Committee” (hereinafter referred to as the “Emergency Countermeasure Committee”), and, on April 11, 2017, prepared a notice of convening a management body meeting’s meeting to convene a general meeting on April 22, 2017 for the establishment, manager and management members of the fixed management body, and the enactment of the management rules, and sent the notice of convening the meeting to the address of each sectional owner’s exclusive ownership on April 12, 2017.
According to the above notification, the management body meeting was held on April 22, 2017. At the above management body meeting, F declared that F was elected as the manager of the management body of the building of this case with the consent of 293 square meters with the consent of 49,908.43 square meters in total, which is a majority of 521 sectional owners, and a majority of 25,939.9478 square meters in size of all sections of exclusive ownership, consisting of 293 voting rights and 9 persons who are the supporting persons among those delegated by F and G from each sectional owner.
E. On May 29, 2017, the management body of the instant building was issued a certificate of identification number of the management body, the representative of which is F, by the head of the tax office of the same orchard.
