A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

피고인은 2013. 1. 2.경부터 같은 달 23.경까지 원주시 B게임장’에서 등급분류를 받은 ‘씨 파라다이스' 게임기 40대를 설치함에 있어, 위 게임물은 등장하는 물고기의 종류에 따라 100점부터 500점까지 각기 다른 점수가 부여되어 이용자가 위 물고기를 비눗방울로 맞추어 누적점수가 5,000점 이상이 되면 경품이 배출되는 등 이용자의 능력에 따라 당첨이 결정되고, 방해물인 성게는 3초에 한 번씩 출현하는 내용으로 등급분류를 받았음에도 불구하고, 거북이, 가오리, 상어, 고래 등의 특정한 무늬가 등장하여 예시기능이 발현되면 모든 물고기에 500점의 점수가 부여되고 방해물인 성게가 5초에 한 번씩 출현하도록 그 내용이 변경된 게임기 40대를 설치하여 이를 불특정 다수의 손님들이 이용하도록 하였다.
