피고인은 2014. 1. 19.경 대구 중구 동성로에 있는 칵테일 바에서 만나 알게 된 피해자 B(여, 22세)에게 만나자고 제의하였으나 거절당하자, 2014. 1. 25. 19:00경 카카오톡으로 피해자에게 “I got a girlfriend too, really but I just wanted to enjoy sex with you“, ”I can sex you tonight if you want to enjoy my black dick~~~ I like your hole but I don’t like your body shape“(사실은 나도 여자 친구가 있다, 사실 너랑 섹스하고 싶었다, 오늘 밤에 네가 흑인의 성기를 즐기기를 원한다면 오늘밤 섹스를 할 수 있다, 나는 너의 구멍을 좋아하지, 너의 몸매를 좋아하는 것은 아니다)라는 내용의 메시지를 전송하고, 2014. 1. 27. 23:20경 페이스북으로 피해자에게 “Did you clean ur pussy(hole) tonight already bitch ”, “You know you like black dick soo much. But can’t give you. Put your figure in ur hole&sex urself tonight before you go to bed, bitch. You are hungry for my dick I know really”, (너 오늘 똥구멍은 씻었냐 너도 네가 큰 남자 성기를 좋아하는 걸 알지 않느냐, 네 손가락을 네 구멍에 넣어서 자위를 해라, 나는 네가 내 성기 때문에 배고파하는 걸 안다)라는 내용의 메시지를 전송하였다.

Accordingly, the Defendant sent to the victim a writing that may cause sexual humiliation or aversion through the communication media with a view to inducing or satisfying his own sexual desire.
