A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant is a person engaging in driving a CAD A6 car.
On May 28, 2014, the Defendant driven the above vehicle at a speed of 21:00, and driven the road of four-lanes in front of the Incheon High School bus stops located in the Taepo-ri, Gopo-si, Gopo-si, Kimpo-si, Kimpo-si, along the two-lanes from Seoul bank to Kimpo-sections.
At night, it was difficult at that time, and the defendant had a duty of care to change the vehicle only when there is no risk of collision, considering the distance between the vehicle in front of the moving direction and the vehicle in the change of the vehicle, as the victim D (the 51 year old) driving in the same direction passes along the Echier car and the two lanes to the first lane.
Nevertheless, the Defendant neglected to do so and received the parts behind the right side of the vehicle driving by the victim in front of the left-hand side of the Aurdi A6-car operated by the Defendant due to the negligence of changing the vehicle in close close vicinity, without neglecting it.
Ultimately, the Defendant caused the injury to the victim D, such as salt, tensions, etc. in need of medical treatment for about three weeks due to occupational negligence as above; suffered injury to the victim F (n, 48 years of age) who was on board the franchiseer car in need of medical treatment for about three weeks; and at the same time, the Defendant attempted to stop the franchiseer car and escape without taking necessary measures, such as aiding and abetting the victim, even though the repair cost, such as the wheel replacement, etc., to reach KRW 1,097,347.
