Defendant
A shall be punished by imprisonment with prison labor for six months and by imprisonment for four months.
However, for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
No one shall cause a trouble to an information and communications network with intent to interfere with stable operation of the information and communications network by sending a large amount of signals or data, letting the network process an illegitimate order, or inputting a false information or improper order into an information processing device, such as a computer, or causing trouble to the processing of information by any other means.
1. On April 5, 2013, Defendant A certified the victim F (representative G)’s VPN service to attack the user of the server of the Twitdong Broadcasting, Guro-gu Seoul Metropolitan Government E 405, and obstructed the victim’s business of providing the victim company’s private Internet network at the same time as the Internet attack program, i.e., “UDP Floder” and “HWn”, i.e., “HWnnn” and “HWnnn”, once more than four times. As a result, Defendant A sent a large volume of data to the Trodong Broadcasting server by means of entering the Tropin number and the Port number of the Tropin Broadcasting server, and thereby causing disorder to the system, thereby hindering the victim company’s business of providing the private Internet network.
2. Defendant B
A. In fact, the Defendant, at around April, 2013, received KRW 600,00 from the victim H in return for a DNA attack against the IBBBB, he/she would, even if he/she did not have any intent or ability to conduct a DNA attack against the said website, give 60,000 won to the victim, if he/she paid 60,000 won to the victim.
Along on the 8th day of the same month from the injured party, he/she received 600,000 won from the injured party by means of the Agricultural Cooperative Account (Account Number J) in the name of the accused.
(b) Any person who violates the Act on Promotion of Use of Information and Communications Network and Information Protection, etc., shall be aware of any divulged personal information for profit or unjust purpose;
