1. The instant lawsuit shall be dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
A lawsuit seeking performance of obligations under the current Administrative Litigation Act is not recognized (see, e.g., Supreme Court Decision 91Nu4126, Feb. 11, 1992). The instant lawsuit constitutes a lawsuit seeking performance of obligations to the effect that “the Minister of Environment requests the Plaintiff to do so.”
Therefore, the lawsuit of this case is unlawful and dismissed, and it is so decided as per Disposition.
