All appeals are dismissed.
Reasons
The grounds of appeal are examined.
1. Examining the reasoning of the lower judgment on the grounds of Defendant A’s appeal in light of the evidence duly admitted by the lower court, the lower court was justifiable to have determined that Defendant A was guilty of this case’s facts charged (excluding the acquittal and the acquittal portion of the grounds for appeal) on the grounds indicated in its reasoning. In so doing, the lower court did not err by failing to exhaust all necessary deliberations, as alleged in the grounds of appeal, exceeding the bounds of the principle of free evaluation in violation of logical and empirical rules
2. Examining the reasoning of the lower judgment on the grounds of Defendant B’s appeal in light of the evidence duly admitted by the lower court, the lower court was justifiable to have determined that the lower court convicted Defendant B of taking occupational embezzlement and taking property in breach of trust (excluding the part of innocence) among the facts charged in the instant case against Defendant B on the grounds indicated in its reasoning. In so doing, contrary to what is alleged in the grounds of appeal, the lower court did not err by exceeding the bounds of the principle of free evaluation of evidence
In addition, the argument that there was an error of misunderstanding of the legal principles or misconception of the facts as to the fraud of the crime list (2), (3) of the facts charged in this case against Defendant B as indicated in the judgment of the court below, is alleged by Defendant B only for the grounds of appeal that it was based on the appeal, or that the court below did not consider it as being subject to the judgment ex officio, and it does not constitute a legitimate ground for appeal. The argument that the first instance court and the court below delayed the trial procedure, does not constitute the grounds for appeal under Article 383 of the Criminal Procedure Act,
3. Therefore, all appeals are dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
