The punishment of the accused shall be determined by two years of imprisonment.

However, the above sentence shall be executed for four years from the date this judgment became final and conclusive.

피고인은 2015. 6. 4. 20:50경 광주 북구 C에 있는 D라는 상호의 주점에서 평소 알고 지내는 피해자 E(53세)에게 “낮에 윷놀이를 하면서 왜 나한테 욕을 하고 성질냈냐 ”라고 말하면서 잠깐 밖에서 보자고 하여 피해자와 함께 식당 밖으로 나갔는데, 피해자가 “이 씹할”이라고 욕설을 하면서 신경질을 내고 식당 안으로 들어가자 피해자를 뒤따라가 위 주점 내 탁자 위에 놓여있던 위험한 물건인 맥주병을 오른손에 들고 피해자의 머리를 1회 내리치고, 피해자의 머리에 부딪혀 깨진 맥주병으로 피해자의 허벅지와 손을 찔러 피해자에게 약 6주간의 치료를 요하는 ‘우측 제4번 손가락 신전건 파열(견열골절), 좌측 대퇴의 열린상처’ 등을 가함으로써 위험한 물건을 휴대하여 피해자에게 상해를 가하였다.
