A defendant shall be punished by imprisonment for one year.

Punishment of the crime

1. The Defendant, against the victim D, had the intent to arbitrarily sell the pine trees on the forest land owned by a school foundation M&D and obtain the proceeds therefrom through E, and around December 15, 2012, the Defendant prepared and sold a letter of delegation to E, “A G representative director of G who is scheduled to take over the F.F.M. Yangyang-gun, which is within the relevant site, to build a 18th cubic building on the said site. The Defendant has the right to sell pine trees to B with 400 in forests and fields, and the date of extraction permission within two to three months. Not less than 30 cc in diameter (30 cm), the Defendant sold pine trees in KRW 300,000,000 and the remainder of 100 cump”, and the letter of delegation was prepared.

이에 따라 E은 2012. 12. 20.경 속초시 J에 있는 E의 집에서 피해자 D에게 “A 회장이 F대학교 양양캠퍼스를 매입해서 건물 신축을 하는데, 내가 페인트, 방수 공사를 하도급 받기로 하였고, 내 아들이 토목공사를 맡았다. 위 H(실제 지번은 I) 임야에서 소나무 400주가 나오는데, 내가 A으로부터 소나무 판매에 대하여 위임을 받아 놨고, 2~3개월 내에 굴취 허가가 날 것이다. 그 400주를 4,500만 원에 사라. 그 소나무를 굴취해 팔아서 나, 당신, 굴취 작업을 담당할 K가 30% 씩 나누어 가지고 나머지 10%는 경비로 쓰자. 먼저 계약금 1,500만 원을 주고, 잔금 3,000만 원은 굴취 허가가 나오면 달라.”고 말하고 피해자와 현장 답사를 한 다음 2012. 2. 26.경 위 집에서 피해자와 대금 4,500만 원에 소나무 매매 계약을 체결하였다.

On February 7, 2013, the Defendant continuously presented to E a forged certificate in the name of "L" official of the Gangwon-do Office, and “Do-do has approved the change of the use of Yangyang Campus in Gangwon-do and will be sent to the Yangyang-gun Office one week, and if 20 days have passed, permission to extract pine trees has been granted.
