1. The instant lawsuit shall be dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Facts of recognition;

A. On September 30, 2014, the Plaintiff reported a marriage with B belonging to the Suwon Police Station, but on October 2, 2015, the Plaintiff reported a divorce on the grounds that B had committed an illegal act with C working at the same police station, and reported a divorce on November 4, 2015. (2) On July 21, 2016, the Plaintiff submitted to the Defendant a written petition to the effect that the Plaintiff’s marital life has broken down due to C.

3) On August 23, 2016, the Plaintiff served the following notice from the Defendant, and on August 25, 2016, the information pertaining to the process of disciplinary action and the details of disciplinary action against the Defendant (hereinafter “information of this case”).

(4) On August 29, 2016, the Defendant made a decision to keep the instant information confidential on the ground that the disclosure of the information pertaining to an individual under Article 9(1)6 of the Official Information Disclosure Act (hereinafter “Information Disclosure Act”) is likely to infringe on the privacy or freedom of private life, in view of the fact that the notifying respondent made an inappropriate speech to the spouse of a married petitioner, and that he/she committed an unlawful act even in the court ruling, and that he/she committed an unlawful act.

B. On September 8, 2016, the Plaintiff, who is dissatisfied with the decision of non-disclosure, filed an objection against the decision of non-disclosure on September 8, 2016, the Defendant, on September 19, 2016, not only falls under the information under Article 9(1)6 of the Information Disclosure Act, but also falls under the personnel management under Article 9(1)5 of the same Act, which would significantly impede the fair performance of duties if disclosed.
