A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

The Defendant, under the nationality of the People's Republic of China, committed a tax evasion in the Dogmun-si in China, and was suspected of having committed an attempted crime, and was designated by the Chinese government, the Defendant's name was as D (D) and the date of birth was issued with D'E', and entered the Republic of Korea around June 20, 201 by using D'(D), and acquired the nationality of the Republic of Korea under the name of D'B', "Korean name" on April 26, 2004.

On August 30, 201, the Defendant violated the Passport Act and falsely entered in a passport, when preparing an application for issuance of a passport to the Defendant in the civil petition passport division of Geumcheon-gu Seoul Metropolitan Government Office, the Defendant entered “B” and “E” in the name column, attached the Defendant’s photograph in the photograph column, submitted it to the public official in charge of issuing the passport, and the public official in charge issued the passport of the Republic of Korea in the above name to the Defendant.

As a result, the defendant made a false report to a public official, entered false facts in a passport, and received a passport by unlawful means.

2. Violation of the Immigration Control Act and any false entry and passport execution;

(a) When a foreigner departs from the Republic of Korea, he/she shall undergo an examination by immigration officers at the port of entry and departure with a valid passport;

Around November 5, 2011, the Defendant issued a false entry passport in the Incheon Airport departure inspection place, and the Defendant issued a false entry passport in the name of the Republic of Korea under the false name B under the false name of the Republic of Korea under the false representation of the Chinese national but to the public official in charge of immigration inspection, and left the Republic of Korea through the Incheon Airport without a valid passport issued by the Chinese government.

(b) If a foreigner intends to enter the Republic of Korea, he/she shall have a valid passport and visa issued by the Minister of Justice;
