1. The defendant shall jointly and severally with C Co., Ltd. to the plaintiff KRW 45,805,419 and its amount from November 29, 2018 to May 31, 2019.

1. From January 19, 2018 to March 26, 2018, an indication C Co., Ltd. supplied goods of KRW 45,805,419 from the Plaintiff to March 26, 2018, but did not pay the price for the goods, and the Defendant jointly and severally guaranteed the above goods payment obligation. The Plaintiff sought payment for the above goods payment obligation from the Defendant.

According to the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings (amended by Presidential Decree No. 29768, May 21, 2019), the statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings is 12% per annum from June 1, 2019. Thus, the portion of the claim for damages for delay seeking payment exceeding 12% per annum from June 1, 2019 is rejected.
