A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Criminal facts

From August 16, 2017 to June 8, 2018, the Defendant, while serving as an employee of the Victim B Co., Ltd., and served as the site director at the C Construction Site in Gyeongcheon-nam, was able to draw up and submit a false construction work report, etc. in a way that some of the names of the daily workers who did not work among the daily workers who worked at the construction site were not present at the work site, and then to obtain the difference of the labor cost delivered from the victim company.

Therefore, around September 2017, the Defendant prepared a false work report and work cost statement as if it would have to pay work cost, and submitted it to the person in charge of the victim's name in the case of the victim's company, because the Defendant provided work work work at the work site office around the day when the worker D, E, and F did not work at the work site at the work site.

Therefore, the Defendant, as seen above, by deceiving the victim company from September 2017 to June 2018, received KRW 41,860,500 from the victim company for the total amount of 18 workers in daily employment, as indicated in attached Table 1 and 2.
