피고인들은 피해자 주식회사 넥슨코리아(이하 ‘피해회사’라 한다)가 제공하는 온라인 게임인 ‘던전앤파이터’ (www.df.nexon.com)의 이용자들인데, 게임캐릭터를 원래의 서버에서 다른 서버로 이전 신청한 후 실수로 삭제하였다고 복구 신청하는 수법으로 피해회사를 속여 온라인상에서 고가로 거래되는 게임아이템을 다수 보유한 캐릭터를 편취한 후, 이를 처분하여 재산상 이익을 나누기로 순차 공모하였다.

1.
