1. All of the plaintiff's claims are dismissed.

1. Basic facts

A. The Plaintiff is the owner of the O 965m2 (hereinafter “the Plaintiff’s land”).

Defendant B, the Defendant (Appointed Party) and the designated parties (hereinafter collectively referred to as “the Defendants”) are the owners of the Plaintiff’s neighboring land. Defendant B is the owners of the Plaintiff’s neighboring land, and Defendant B is the 631 square meters and 335 square meters prior to D, Defendant B is the 759 square meters prior to H and 177 square meters prior to G; Defendant B is the 1,688 square meters prior to I; Defendant (Appointed Party) is the 1,688 square meters prior to J; Defendant K is the 925 square meters prior to L; and the designated M is the 91 square meters prior to N. (hereinafter referred to as the “instant Defendants’ land”).

B. The Plaintiff built a building on the Plaintiff’s instant land and cultivated crops in small places. The Defendants, from around 2014 to around 2015, purchased each of the pertinent land, are performing construction works to cultivate the Plaintiff’s land as a dry field to conduct a rice farm on the instant Defendants’ land.

C. In order to enter the Plaintiff’s land for a long time, the Plaintiff used a forest road (as seen in attached Form 1) which is part of Q2,535 square meters of Q2, P owned as a way to pass along the Defendants’ land. In the event of P and dispute, P, the owner of the instant land, installed a steel line in the beginning part of the instant road, and the width of the passage is very narrow, among the development works on the instant land for the Defendants’ land, as part of the intermediate point of the instant road, is cut and the width of the passage is considerably narrow.

한편, 이 사건 피고들 토지의 개간공사 중 공사차량이 진출입하는 과정에서 이 사건 피고들 토지 중 청구취지 1문 기재 각 별지 도면 1 표시 선내 (ㄴ), (ㄹ), (ㅂ), (ㅇ), (ㅋ), (ㅎ), (ㄷ1), (ㅂ1)부분에 임시의 통행로(이하 ‘이 사건 임시 통행로’라 한다)가 개설된 상태이다.
