A defendant shall be punished by imprisonment for five years.

As for half sale on seized articles, 1 punishment (No. 1), 1 punishment (No. 2) shall be applied.

Criminal facts

On May 30, 2012, the Defendant was sentenced to one year of imprisonment with prison labor for night building intrusion larceny at the District Court, and completed the execution of the sentence on April 11, 2013.

At around 06:20 on July 2, 2013, the Defendant: (a) intruded the victim E (n, 46 years of age) and his family members’ house through the second floor bed; (b) followed the victim C (24 years of age)-owned market price of 20,000 won in a living room; (c) continued to suffer half of 30,000 won in a half of 30,000 won in the market price; and (d) concealed the victim F (27 years of age) with the kitchen knife in a kitchen which entered; (d) the victim’s face, such as the victim’s knife and the victim’s face, which were in possession of for the purpose of evading the arrest of defects by opening a door of the victim E and entering the house; and (e) tried to escape the victim’s face from the victim’s knife to the left side, such as the victim’s knife and pressure the victim’s face to the victim’s left side.

Accordingly, the defendant invadeds on the victims' residence, stolen the victims' property, and inflicted an injury on the victims for the purpose of evading arrest.
