3. Determination
A. The defendants' decision to recommend the settlement of claims, such as wages, against D and the mediation of this case acknowledged that the amount of claims, such as wages, against D of the defendants was the defendant A20,032,867 won, defendant B26,527,203 won, and damages for delay against each of the above amounts.
Furthermore, the statement in the evidence No. 10 alone is insufficient to reverse the above facts to acknowledge that the amount of the Defendants’ wages, etc. is merely the same amount as the Plaintiff’s assertion, and there is no other evidence to acknowledge it. Rather, in full view of the overall purport of the arguments as seen earlier, the total amount of the Defendants’ arrears on the column of the amount of delayed payment of substitute payments in each place of business (Evidence No. 10) is regarded as the top priority wage claim subject to substitute payments.
Therefore, the plaintiff's above assertion is without merit.
B. The following facts are acknowledged in light of the evidence and the purport of the entire pleadings in each of the statements in Gap evidence Nos. 8 and 9, which were revealed prior to the premise of the determination. (A) The details of claims, such as unpaid wages, against the Defendants of D are as follows.
