A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On November 24, 2012, the Defendant made a false statement that “A” of the victim C’s “D” in the beauty room of the trade name “A” located in Yansan-gu Seoul-si, Jeonju-si, stating that “A husband who is a public educational official would receive a retirement allowance if his husband who is a public educational official would have reached a few months of the preparation for the examination in Seoul.” As such, the Defendant made a false statement to the victim that “I may lend his/her husband, even if he/she lends his/her her 10 million won to another person.”
However, even if the defendant borrowed money from the victim, he did not have the intention or ability to repay it.
The Defendant, as such, by deceiving the victim, received KRW 9.8 million from the victim around November 27, 2012.
2. Around December 24, 2012, the Defendant called the victim’s phone call from Masan-gu Embaeng-gu, Seoul Special Metropolitan City, and concluded that “A deposit should not be made as KRW 10,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000 won.”
However, even if the defendant borrowed money from the victim, he did not have the intention or ability to repay it.
The Defendant, as such, by deceiving the victim, received KRW 16.6 million from the victim around December 31, 2012.
(C) On January 20, 2013, the Defendant called the victim, and called the victim, and called the victim, to lend KRW 27 million,00,000,000,000 to his/her husband and to his/her father.
