1. All of the plaintiffs' lawsuits against the defendants are dismissed.

2. Of the costs of lawsuit, the part resulting from the participation.

The benefit of confirmation in a lawsuit for confirmation is recognized in cases where there is a dispute between the parties as to the current rights or legal status, and thereby, it is the most effective and appropriate means to determine the legal status of the plaintiff as a confirmation judgment to eliminate such apprehension and risk when the plaintiff’s legal status is unstable and dangerous (see, e.g., Supreme Court Decision 2017Da216271, Jul. 11, 2017). In addition, the defendant of a lawsuit for confirmation is a person who is likely to cause apprehensions about the legal status of the plaintiff by dispute over the plaintiff’s rights or legal status, and if so, the defendant of a lawsuit for confirmation has the benefit of confirmation against the defendant, who is asserting

(see, e.g., Supreme Court Decision 2012Da67399, Feb. 15, 2013). The Defendants did not assert all the rights or legal relations of the Plaintiffs prior to the filing of the instant lawsuit. On the first pleading date, the Defendants present at the Dong-gu, Gwangju, and recognized that there is no claims or obligations between the Plaintiffs and the Defendants regarding the construction of a new complex complex on the ground of the Jeju-gu, and the first pleading date for pleading.

Therefore, the Defendants do not constitute a person who is likely to cause unstable legal status by dispute over the rights or legal relations of the Plaintiffs.

Therefore, the plaintiffs' lawsuit of this case against the defendants is unlawful as there is no benefit of confirmation, and it is so decided as per Disposition by the assent of all.
