A defendant shall be punished by imprisonment for six months.

Punishment of the crime

On June 21, 2016, the Defendant was sentenced to a suspended sentence of two years on August 27, 2016 for the preparation of a private document for qualification at the Ulsan District Court, and the judgment became final and conclusive on December 27, 2016.

The Defendant (State) is a person in charge of the accounting affairs of the C, and (State) C was subcontracted to the E for the structural construction of the building in Kimcheon-si D, Kimcheon-si, and completed the said construction on or around June 7, 2015, but (State) E filed a lawsuit for the payment of the construction cost against (State) C at the issue of the payment of the construction cost, and the Daegu District Court Kimcheon-cheon was 15972 at 15972.

On the other hand, on March 23, 2015, the Defendant had used the amount equivalent to KRW 17,639,659 out of the money owned by C in his own name for personal use by transferring the amount of KRW 17,639,659 to one’s own passbook, and around that time, the Defendant had not paid or lent KRW 17,00,000 to G who subcontracted the said construction work from E to G who was subcontracted the said construction work under the name of the construction cost. However, during the said lawsuit, the Defendant, who was in charge of the accounting, submitted as evidence a statement of the payment of the construction cost in the said lawsuit, and submitted a receipt that he paid the said amount of KRW 17,00,000 as the construction cost, which was useful for the Defendant, to G.

1. On June 2016, the Defendant forged private documents: (a) paid KRW 17,00,000 as a construction cost to G around March 24, 2015; or (b) did not have received a receipt from G as if the Defendant paid the said amount to G as a result of the construction cost; (c) for the purpose of preparing a receipt and submitting it as evidence for the list of payment details; (d) the said amount was deposited into the JF account by using the computer for the purpose of submitting as evidence for the evidence of the list of payment details.
