A defendant shall be punished by imprisonment for six months.

Punishment of the crime

On April 5, 2007, the Defendant was sentenced to imprisonment with prison labor for special robbery, etc. at the Gwangju High Court, and completed the execution of the sentence on April 4, 2009.

1. On February 10, 201, the criminal defendant against the victim C made a false statement to the victim C, “If the victim borrowed 2 million won as he/she suffered an accident and immediately needed to pay the money, he/she will repay the money later when he/she retires.”

However, at the time, the defendant's wife was not involved in the accident and was planned to use the above borrowed money as daily cost.

The Defendant, as above, by deceiving the victim, received KRW 2 million in cash from the victim on the same day.

2. From January 11, 2010 to January 7, 2012, the Defendant has been engaged in the supply and collection of E from the victim C, operated by Kim Jong-si to the business employees.

From July 201 to January 17, 2012, the Defendant spent the amount of KRW 24,323,440 as well as the amount of KRW 34,30,920 in total from six business partners, such as the list of crimes in the attached Table, and used it for personal purposes, such as living expenses and gambling investments.

Accordingly, the defendant embezzled the victim's property.

3. On November 15, 2012, the criminal defendant against the victim G made a false statement that he/she would pay KRW 1600,000 per month to the victim G in a mobile phone agency with I’s mobile phone in Kim Jong-si, Kim Jong-si, under the pretext of public relations expenses for opening two mobile phones.

However, even if the defendant opens a mobile phone in the name of the victim, he did not have the intention or ability to pay publicity expenses.

As above, the Defendant: (a) by deceiving the victim as above; (b) opened two mobile phones (number J and K) from the victim on the same day; (c) used from around that time to December 2012; and (d) used from around that time to around that time.70.
